of Use
Important: By creating an account and using the MKWork Manager platform, you confirm that you have read, understood and agree to these
01 Contracting parties
This agreement governs the contractual relationship between:
- Provider: THEMANIAKS ENGINEERING WORKSHOP SRL, with registered office at Str. Chimistilor 2, Bl. 2, Ap. 42, postal code 505100, Codlea, Brasov county, CUI 46955928, Trade Registry J08/3159/2022, email: contact@mkwork.ro
- Client: any natural or legal person who creates an account and uses the MKWork Manager application
By registering, the Client declares that they have legal capacity to enter into contracts and are acting on behalf of the organization they represent.
02 Service description
MKWork Manager is an industrial production management software application, delivered as a SaaS (Software as a Service), designed for mechanical workshops, CNC manufacturers and factories in Romania. The service includes:
- Projects, parts and production order management
- Employee timekeeping and hour tracking per project
- Materials stock and CNC tool stock (automated magazines)
- Production planning, Gantt, BOM (Bill of Materials)
- Quality module — non-conformances, inspections, CoC
- Subcontracting, delivery and quoting
- Monthly reports, Excel exports, documented REST API
- Internal chat, Kanban, real-time notifications
Note: The provider reserves the right to modify, add or remove service features. Significant changes will be communicated to active Clients at least 14 days in advance.
03 Account and access
- Each organization gets a dedicated workspace identified by a unique slug (e.g.:
mkwork.ro/your-company-name), technically isolated from all other organizations - The organization administrator is responsible for credentials security of all its users
- Sharing accounts with persons outside the organization is prohibited
- Accounts inactive for more than 12 consecutive months may be deleted after 30 days prior notice
- A user can belong to a single organization per account
The client is responsible for all activities carried out in their organization's account, including actions of its users.
04 Subscription plans and pricing
The service is available in several plans described on the Pricing. All prices are expressed in RON and include VAT (where applicable).

Prices may be modified with notification of active Clients at least 30 days in advance. Modifications do not affect already paid periods.
05 Payment methods
- Bank transfer: based on the proforma invoice issued at registration or renewal. The bank account is stated on the proforma.
- Online card payment: when this option is enabled, via a secure payment processor (3D Secure)
Access to paid plan features is activated after payment confirmation by the Provider. Fiscal invoices are issued in accordance with Romanian law.
Non-payment within 15 calendar days from the due date may lead to automatic suspension of access to paid plan features. Organization data is preserved. 30 days.
06 Client obligations
The client undertakes to:
- Provide correct and up-to-date information at registration (company name, VAT number, email)
- Use the service exclusively for lawful and legitimate purposes, in compliance with Romanian and European law
- Not upload illegal, malicious, obscene content or content that infringes third-party intellectual property rights
- Not attempt to access other organizations' data or exploit application vulnerabilities
- Comply with GDPR legislation regarding employee and collaborator data entered into the application — the Client is the data controller in relation to its own employees
- Not use scraping techniques, automated crawling or API abuse without written consent
- Maintain secure passwords and enable two-factor authentication (2FA) when available
Violation of these obligations may lead to Immediate suspension or deletion of the account, without refund and without prior notice in cases of serious abuse.
07 Intellectual property
The MKWork Manager application, including the source code, design, interfaces, documentation, algorithms and all its components, is the exclusive property of THEMANIAKS ENGINEERING WORKSHOP SRL, protected under Law no. 8/1996 on copyright and related rights, and Directive 2009/24/EC.
Client's data: The client holds exclusive ownership rights over all data entered by their organization into the application (parts, projects, technical documents, employees, etc.). The provider does not claim any rights over this data and does not use it for purposes other than providing the service.
08 Availability and SLA
- The provider targets availability of 99% per calendar year for Starter and higher plans
- Planned interruptions (maintenance) are announced at least 24 hours in advance via the status page and/or email
- The provider does not guarantee uninterrupted availability and is not liable for losses caused by technical outages beyond its control (ISP, cloud infrastructure, force majeure)
- Database backups are performed daily, with a minimum retention of 7 days
09 Limitation of liability
The provider is not liable for:
- Data loss caused directly by the Client's or its users' actions
- Indirect damages, lost profits or data loss
- Malfunction caused by third-party infrastructure (Internet, electricity)
- Incompatibility with third-party systems not specified in the documentation
The maximum liability of the Provider is limited to the value of the subscription paid in the last calendar month preceding the occurrence of the damage.
10 Cancellation and refund policy
Full details are available in Cancellation Policy. Summary:
- The client may cancel the subscription at any time — access remains active until the end of the paid period
- No refunds are granted for partially used periods of monthly subscriptions
- The 14-day right of withdrawal applies under OUG 34/2014
11 Modification of terms
The provider may modify these Terms by notifying active Clients at least 15 calendar days before the changes take effect. Notification is sent by email and/or via banner in the application. Continuing to use the service constitutes acceptance.
12 Applicable law and disputes
This agreement is governed exclusively by Romanian law. Any dispute will be resolved, in the first instance, amicably. If unsuccessful, jurisdiction belongs to the courts at the Provider's registered office.
Clients who are consumers may also use the alternative online dispute resolution procedure (SAL) via the ec.europa.eu/consumers/odr.
